HR – Opći uvjeti i odredbe korištenja
Opće odredbe
Ovim Općim uvjetima i odredbama korištenja (u nastavku: Uvjeti) uređuju se pravila korištenja internetskog portala ADRIATIC.properties (u nastavku: Portal), kojim upravlja Melior Consuasor d.o.o., Vladimira Nazora 10, 10431 Brezje, Hrvatska, OIB: 86651636991 (u nastavku: Vlasnik Portala).
Korištenjem Portala korisnik potvrđuje da je upoznat s ovim Uvjetima te da ih u cijelosti prihvaća.
Definicije pojmova
- Portal – internetski portal ADRIATIC.properties namijenjen oglašavanju nekretnina.
- Korisnik – svaka fizička ili pravna osoba koja pristupa Portalu i/ili koristi njegove usluge, uključujući osobe koje to čine u ime i za račun pravne osobe.
- Oglašivač – korisnik koji putem Portala oglašava nekretninu.
- Oglas – objava koja sadrži podatke o nekretnini ponuđenoj na prodaju.
- Vlasnik Portala – Melior Consuasor d.o.o.
Korisnici i registracija
Pristup Portalu omogućen je svim korisnicima bez obveze registracije. Za objavu oglasa potrebno je kreirati korisnički račun.
Prilikom registracije korisnik je dužan navesti točne, potpune i ažurne podatke te je odgovoran za njihovu vjerodostojnost.
Korisnik je odgovoran za čuvanje pristupnih podataka te za sve radnje izvršene putem njegova korisničkog računa.
Vlasnik Portala zadržava pravo onemogućiti pristup Portalu i/ili ukloniti korisnički račun u slučaju kršenja ovih Uvjeta ili važećih propisa.
Usluge Portala
Portal ADRIATIC.properties omogućuje korisnicima sljedeće usluge:
- Objavu oglasa nekretnina – korisnici mogu putem Portala oglašavati nekretnine ponuđene na prodaju.
- Pregled i pretraživanje oglasa – svi korisnici mogu pretraživati i pregledavati oglase dostupne na Portalu.
- Uspostavu kontakta – Portal omogućuje kontakt između oglašivača i zainteresiranih korisnika putem podataka navedenih u oglasima radi dogovora oko kupoprodaje nekretnine.
Portal ne sudjeluje u kupoprodajnim transakcijama te ne preuzima odgovornost za točnost, potpunost ili zakonitost sadržaja oglasa, niti za pravne ili faktičke odnose koji nastanu između korisnika. Portal ne jamči uspješnost prodaje nekretnine.
Oglašavanje nekretnina
Oglašivač jamči da je ovlašten oglašavati nekretninu te da su svi podaci sadržani u oglasu točni, potpuni i zakoniti.
Oglašivač je dužan osigurati da oglas sadrži istinite i ažurne podatke o nekretnini, osobito u pogledu lokacije, površine, cijene i pravnog statusa.
Zabranjeno je objavljivanje oglasa koji:
- sadrže neistinite ili obmanjujuće podatke,
- krše prava trećih osoba,
- su protivni važećim propisima ili dobrim običajima.
Vlasnik Portala zadržava pravo u svakom trenutku, bez prethodne obavijesti, ukloniti oglas za koji ocijeni da je u suprotnosti s ovim Uvjetima ili važećim propisima te privremeno ili trajno onemogućiti objavu oglasa određenom korisniku.
Obveze korisnika
Korisnici su dužni koristiti Portal u skladu s važećim propisima Republike Hrvatske, ovim Uvjetima i pravilima dobre poslovne prakse.
Korisnicima je zabranjeno:
- koristiti Portal u svrhe protivne zakonu ili dobrim običajima,
- unositi ili objavljivati netočne, obmanjujuće ili nezakonite podatke,
- zloupotrebljavati funkcionalnosti Portala ili ometati njegovo funkcioniranje,
- objavljivati sadržaje koji krše prava trećih osoba.
Korisnik se obvezuje suzdržati se od bilo kakvog postupanja koje bi moglo uzrokovati štetu Portalu, Vlasniku Portala ili drugim korisnicima.
U slučaju kršenja ovih obveza, Vlasnik Portala zadržava pravo poduzeti odgovarajuće mjere, uključujući ograničenje ili ukidanje pristupa Portalu.
Korisnicima je zabranjeno neovlašteno prikupljanje, prijenos, umnožavanje, automatizirano preuzimanje (scraping) ili drugo daljnje korištenje informacija dostupnih na Portalu, osobito u komercijalne svrhe, bez prethodnog odobrenja Vlasnika Portala.
Korisnik potvrđuje i prihvaća da Portal, kao i svi sadržaji i usluge dostupni putem Portala, koristi na vlastitu odgovornost te da Vlasnik Portala ne snosi odgovornost za eventualnu štetu nastalu korištenjem Portala, osim u mjeri u kojoj je takva odgovornost propisana obveznim propisima.
Prava i odgovornosti Vlasnika Portala
Vlasnik Portala zadržava pravo u svakom trenutku izmijeniti, privremeno ili trajno obustaviti funkcioniranje Portala ili pojedinih njegovih dijelova, bez prethodne obavijesti korisnicima.
Vlasnik Portala ima pravo, prema vlastitoj procjeni, ukloniti ili izmijeniti bilo koji sadržaj objavljen na Portalu za koji ocijeni da je u suprotnosti s ovim Uvjetima, važećim propisima ili pravilima dobre poslovne prakse.
Vlasnik Portala ne jamči neprekidan i neometan pristup Portalu niti ispravno funkcioniranje, prikaz ili korištenje sadržaja dostupnih na Portalu, osobito u slučajevima tehničkih poteškoća, prekida rada sustava, održavanja ili drugih izvanrednih okolnosti izvan njegove kontrole.
Vlasnik Portala ne snosi odgovornost za sadržaje, informacije, proizvode ili usluge dostupne putem poveznica na internetske stranice ili aplikacije trećih osoba, niti za točnost i zakonitost takvih sadržaja.
Vlasnik Portala, kao ni treće strane čiji su sadržaji dostupni putem Portala, ne odgovaraju za bilo kakvu štetu, troškove ili potraživanja koja mogu nastati kao posljedica:
- tehničkih smetnji, prekida ili pogrešaka u radu elektroničkih komunikacijskih mreža i sustava,
- korištenja zlonamjernih programa, uključujući viruse ili slične zlonamjerne sadržaje,
- neispravnog, nepravilnog ili neovlaštenog korištenja Portala,
- problema uzrokovanih korištenjem nekompatibilnih, zastarjelih ili neispravnih uređaja, softvera ili internetskih preglednika,
- drugih okolnosti koje mogu utjecati na dostupnost, funkcionalnost, sigurnost ili pravilno korištenje Portala, neovisno o tome jesu li predvidive ili nepredvidive te nalaze li se unutar ili izvan kontrole Vlasnika Portala.
Intelektualno vlasništvo
Vlasnik Portala isključivi je i zakoniti nositelj prava na Portal, uključujući web stranicu, aplikacije i sve njihove sastavne elemente, kao što su tekstovi, dokumenti, fotografije, crteži, grafike, baze podataka, softver, logotipi, zaštitni znakovi i drugi znakovi zaštićeni pravima intelektualnog ili industrijskog vlasništva.
Osim ako korisnik nema izričitu pisanu suglasnost Vlasnika Portala ili trećih osoba koje posjeduju odgovarajuća prava, ili ako nije zakonski ovlašten, zabranjeno je:
- reproducirati, mijenjati, prilagođavati ili transformirati bilo koji sadržaj Portala,
- dekodirati, distribuirati, javno priopćavati ili iznajmljivati sadržaje,
- učiniti sadržaje dostupnima trećim osobama.
Korisnik smije koristiti sadržaj Portala isključivo u svrhu osobnog, nekomercijalnog korištenja i u skladu s ovim Uvjetima. Svako drugo korištenje sadržaja, osobito u komercijalne svrhe ili radi distribucije, zabranjeno je bez prethodne pisane suglasnosti.
Sadržaji koje korisnici objavljuju putem Portala (npr. oglasi) moraju biti u skladu s važećim propisima i ne smiju kršiti prava trećih osoba, uključujući autorska prava i prava intelektualnog vlasništva. Korisnik jamči da posjeduje prava na materijal koji objavljuje te da objavom ne povređuje prava trećih osoba.
Zaštita osobnih podataka
Vlasnik Portala obrađuje osobne podatke korisnika u skladu s važećim propisima o zaštiti osobnih podataka, uključujući Opću uredbu o zaštiti podataka (GDPR).
Detaljne informacije o obradi osobnih podataka, svrsi obrade, pravima korisnika i drugim relevantnim informacijama dostupne su u Politici privatnosti objavljenoj na Portalu.
Izmjene Općih uvjeta
Vlasnik Portala zadržava pravo u svakom trenutku izmijeniti ili dopuniti ove Uvjete. Izmjene stupaju na snagu danom objave na Portalu te se od tog trenutka primjenjuju na sve korisnike.
Mjerodavno pravo i nadležnost
Na ove Uvjete primjenjuje se pravo Republike Hrvatske, osim ako obveznim propisima nije drugačije određeno.
Za sve sporove koji mogu proizaći iz korištenja Portala nadležan je stvarno nadležni sud u Republici Hrvatskoj prema sjedištu Vlasnika Portala.

EN – Terms and Conditions of Use
General provisions
These Terms and Conditions of Use (the Terms) govern the use of the ADRIATIC.properties online portal (the Portal), operated by Melior Consuasor d.o.o., Vladimira Nazora 10, 10431 Brezje, Croatia, OIB: 86651636991 (the Portal Owner).
By using the Portal, the user confirms that they have read and understood these Terms and accepts them in full.
Definitions
- Portal – the ADRIATIC.properties online portal intended for real estate advertising.
- User – any natural or legal person who accesses the Portal and/or uses its services, including persons acting on behalf of and for the account of a legal entity.
- Advertiser – a user who advertises a property via the Portal.
- Listing – a post containing information about a property offered for sale.
- Portal Owner – Melior Consuasor d.o.o.
Users and registration
Access to the Portal is available to all users without registration. To publish a listing, a user account must be created.
When registering, the user must provide accurate, complete and up-to-date information and is responsible for its correctness.
The user is responsible for keeping their login credentials secure and for all actions performed through their user account.
The Portal Owner reserves the right to disable access to the Portal and/or remove a user account in the event of a breach of these Terms or applicable laws.
Portal services
The ADRIATIC.properties Portal provides the following services:
- Publishing property listings – users may advertise properties offered for sale via the Portal.
- Browsing and searching listings – all users may browse and search listings available on the Portal.
- Contact facilitation – the Portal enables contact between advertisers and interested users via the contact details provided in listings for the purpose of arranging a property sale.
The Portal does not participate in sale transactions and assumes no responsibility for the accuracy, completeness or legality of listing content, nor for any legal or factual relationships arising between users. The Portal does not guarantee the successful sale of any property.
Property advertising
The advertiser warrants that they are authorised to advertise the property and that all information contained in the listing is accurate, complete and lawful.
The advertiser must ensure that the listing contains truthful and up-to-date information about the property, in particular regarding location, size, price and legal status.
It is prohibited to publish listings that:
- contain false or misleading information,
- infringe third-party rights,
- are contrary to applicable laws or good practice.
The Portal Owner reserves the right, at any time and without prior notice, to remove any listing deemed to be in breach of these Terms or applicable laws and to temporarily or permanently prevent a user from publishing listings.
User obligations
Users must use the Portal in accordance with Croatian law, these Terms and good business practice.
Users are prohibited from:
- using the Portal for purposes contrary to law or good morals,
- entering or publishing inaccurate, misleading or unlawful information,
- misusing Portal functionalities or interfering with its operation,
- publishing content that infringes third-party rights.
The user undertakes to refrain from any conduct that could cause damage to the Portal, the Portal Owner or other users.
In the event of a breach, the Portal Owner may take appropriate measures, including restricting or terminating access to the Portal.
Users are prohibited from unauthorised collection, transfer, reproduction, automated extraction (scraping) or other further use of information available on the Portal, especially for commercial purposes, without the Portal Owner’s prior approval.
The user acknowledges and accepts that they use the Portal and all content and services available through the Portal at their own risk, and that the Portal Owner shall not be liable for any damage resulting from the use of the Portal, except where such liability is required by mandatory law.
Rights and responsibilities of the Portal Owner
The Portal Owner reserves the right to modify, temporarily suspend or permanently discontinue the Portal or any part of it at any time without prior notice.
The Portal Owner may, at its sole discretion, remove or modify any content published on the Portal that it deems to be contrary to these Terms, applicable laws or good business practice.
The Portal Owner does not guarantee uninterrupted or error-free access to the Portal, nor the correct functioning, display or use of content on the Portal, especially in cases of technical issues, system interruptions, maintenance or other extraordinary circumstances beyond its control.
The Portal Owner is not responsible for content, information, products or services available via links to third-party websites or applications, nor for the accuracy or legality of such content.
Neither the Portal Owner nor third parties whose content is accessible through the Portal shall be liable for any damage, costs or claims arising as a result of:
- technical disruptions, interruptions or errors in electronic communications networks and systems,
- use of malicious software, including viruses or similar harmful content,
- incorrect, improper or unauthorised use of the Portal,
- issues caused by incompatible, outdated or faulty devices, software or web browsers,
- other circumstances that may affect the availability, functionality, security or proper use of the Portal, whether foreseeable or unforeseeable and whether within or beyond the Portal Owner’s control.
Intellectual property
The Portal Owner is the exclusive and lawful holder of rights to the Portal, including the website, applications and all elements thereof, such as texts, documents, photographs, drawings, graphics, databases, software, logos and trademarks, as well as other signs protected by intellectual or industrial property rights.
Unless the user has the Portal Owner’s or relevant third parties’ express written consent, or is otherwise legally authorised, it is prohibited to:
- reproduce, modify, adapt or transform any Portal content,
- decode, distribute, publicly communicate or rent out content,
- make content available to third parties.
Users may use Portal content solely for personal, non-commercial purposes and in accordance with these Terms. Any other use, especially for commercial purposes or distribution, is prohibited without prior written consent.
Content published by users via the Portal (e.g., listings) must comply with applicable laws and must not infringe third-party rights, including copyright and intellectual property rights. The user warrants that they hold the rights to the material they publish and that publication does not violate third-party rights.
Personal data protection
The Portal Owner processes users’ personal data in accordance with applicable data protection regulations, including the General Data Protection Regulation (GDPR).
Detailed information about personal data processing, purposes of processing, users’ rights and other relevant information is available in the Privacy Policy published on the Portal.
Changes to the Terms
The Portal Owner reserves the right to amend or supplement these Terms at any time. Changes take effect upon publication on the Portal and apply to all users from that moment.
Governing law and jurisdiction
These Terms are governed by the laws of the Republic of Croatia, unless mandatory provisions provide otherwise.
Any disputes arising from the use of the Portal shall be subject to the competent court in the Republic of Croatia according to the registered seat of the Portal Owner.

Durch die Nutzung des Portals bestätigt der Nutzer, dass er diese Bedingungen gelesen und verstanden hat und sie in vollem Umfang akzeptiert.
Begriffsbestimmungen
- Portal – das Online-Portal ADRIATIC.properties zur Bewerbung von Immobilien.
- Nutzer – jede natürliche oder juristische Person, die auf das Portal zugreift und/oder dessen Dienste nutzt, einschließlich Personen, die im Namen und für Rechnung einer juristischen Person handeln.
- Inserent – ein Nutzer, der über das Portal eine Immobilie bewirbt.
- Inserat – ein Beitrag mit Informationen über eine zum Verkauf angebotene Immobilie.
- Portalbetreiber – Melior Consuasor d.o.o.
Nutzer und Registrierung
Der Zugriff auf das Portal ist für alle Nutzer ohne Registrierung möglich. Für die Veröffentlichung eines Inserats ist die Erstellung eines Nutzerkontos erforderlich.
Bei der Registrierung ist der Nutzer verpflichtet, korrekte, vollständige und aktuelle Angaben zu machen und ist für deren Richtigkeit verantwortlich.
Der Nutzer ist für die sichere Aufbewahrung seiner Zugangsdaten sowie für alle Handlungen verantwortlich, die über sein Nutzerkonto erfolgen.
Der Portalbetreiber behält sich das Recht vor, den Zugang zum Portal zu sperren und/oder ein Nutzerkonto zu entfernen, wenn diese Bedingungen oder geltende Vorschriften verletzt werden.
Dienste des Portals
Das Portal ADRIATIC.properties bietet insbesondere folgende Dienste an:
- Veröffentlichung von Immobilieninseraten – Nutzer können über das Portal Immobilien zum Verkauf bewerben.
- Anzeige und Suche – alle Nutzer können die auf dem Portal verfügbaren Inserate durchsuchen und ansehen.
- Kontaktvermittlung – das Portal ermöglicht den Kontakt zwischen Inserenten und interessierten Nutzern über die in Inseraten angegebenen Kontaktdaten, um den Immobilienverkauf zu vereinbaren.
Das Portal nimmt nicht an Kauf-/Verkaufstransaktionen teil und übernimmt keine Verantwortung für die Richtigkeit, Vollständigkeit oder Rechtmäßigkeit der Inseratsinhalte sowie für rechtliche oder tatsächliche Beziehungen, die zwischen Nutzern entstehen. Das Portal garantiert keinen erfolgreichen Verkauf einer Immobilie.
Immobilienbewerbung
Der Inserent gewährleistet, dass er zur Bewerbung der Immobilie berechtigt ist und dass alle im Inserat enthaltenen Angaben korrekt, vollständig und rechtmäßig sind.
Der Inserent ist verpflichtet sicherzustellen, dass das Inserat wahrheitsgemäße und aktuelle Angaben enthält, insbesondere zu Lage, Fläche, Preis und rechtlichem Status.
Es ist untersagt, Inserate zu veröffentlichen, die:
- falsche oder irreführende Angaben enthalten,
- Rechte Dritter verletzen,
- gegen geltendes Recht oder gute Sitten verstoßen.
Der Portalbetreiber behält sich das Recht vor, jederzeit und ohne vorherige Mitteilung Inserate zu entfernen, die nach seiner Einschätzung gegen diese Bedingungen oder geltendes Recht verstoßen, sowie Nutzer vorübergehend oder dauerhaft von der Veröffentlichung auszuschließen.
Pflichten der Nutzer
Nutzer sind verpflichtet, das Portal gemäß den geltenden Vorschriften der Republik Kroatien, diesen Bedingungen und guter Geschäftspraxis zu nutzen.
Nutzern ist untersagt:
- das Portal zu Zwecken zu nutzen, die gegen Gesetz oder gute Sitten verstoßen,
- unrichtige, irreführende oder rechtswidrige Angaben einzugeben oder zu veröffentlichen,
- Funktionen des Portals zu missbrauchen oder den Betrieb zu beeinträchtigen,
- Inhalte zu veröffentlichen, die Rechte Dritter verletzen.
Der Nutzer verpflichtet sich, jedes Verhalten zu unterlassen, das dem Portal, dem Portalbetreiber oder anderen Nutzern Schaden zufügen könnte.
Bei Verstößen behält sich der Portalbetreiber das Recht vor, angemessene Maßnahmen zu ergreifen, einschließlich der Einschränkung oder Beendigung des Zugangs zum Portal.
Untersagt sind insbesondere die unbefugte Erhebung, Übertragung, Vervielfältigung, automatisierte Auslesung (Scraping) oder sonstige Weiterverwendung von Informationen, die auf dem Portal verfügbar sind, insbesondere zu kommerziellen Zwecken, ohne vorherige Zustimmung des Portalbetreibers.
Der Nutzer erkennt an, dass er das Portal sowie alle über das Portal verfügbaren Inhalte und Dienste auf eigenes Risiko nutzt und dass der Portalbetreiber für etwaige Schäden aus der Nutzung des Portals nicht haftet, soweit eine Haftung nicht durch zwingendes Recht vorgeschrieben ist.
Rechte und Verantwortlichkeiten des Portalbetreibers
Der Portalbetreiber behält sich das Recht vor, das Portal oder einzelne Teile jederzeit zu ändern, vorübergehend auszusetzen oder dauerhaft einzustellen, ohne vorherige Mitteilung.
Der Portalbetreiber ist berechtigt, nach eigenem Ermessen Inhalte zu entfernen oder zu ändern, die nach seiner Einschätzung gegen diese Bedingungen, geltendes Recht oder gute Geschäftspraxis verstoßen.
Der Portalbetreiber gewährleistet keinen ununterbrochenen und störungsfreien Zugang zum Portal und keine fehlerfreie Funktion, Darstellung oder Nutzung der Inhalte, insbesondere bei technischen Problemen, Systemausfällen, Wartungsarbeiten oder anderen außergewöhnlichen Umständen außerhalb seiner Kontrolle.
Der Portalbetreiber übernimmt keine Verantwortung für Inhalte, Informationen, Produkte oder Dienstleistungen, die über Links zu Websites oder Anwendungen Dritter zugänglich sind, und auch nicht für deren Richtigkeit oder Rechtmäßigkeit.
Weder der Portalbetreiber noch Dritte, deren Inhalte über das Portal zugänglich sind, haften für Schäden, Kosten oder Ansprüche, die insbesondere entstehen durch:
- technische Störungen, Unterbrechungen oder Fehler in elektronischen Kommunikationsnetzen und -systemen,
- die Nutzung schädlicher Software, einschließlich Viren oder ähnlicher Schadprogramme,
- falsche, unsachgemäße oder unbefugte Nutzung des Portals,
- Probleme aufgrund inkompatibler, veralteter oder fehlerhafter Geräte, Software oder Webbrowser,
- sonstige Umstände, die die Verfügbarkeit, Funktionalität, Sicherheit oder ordnungsgemäße Nutzung des Portals beeinflussen können, unabhängig davon, ob sie vorhersehbar oder unvorhersehbar sind und ob sie innerhalb oder außerhalb der Kontrolle des Portalbetreibers liegen.
Geistiges Eigentum
Der Portalbetreiber ist der ausschließliche und rechtmäßige Inhaber der Rechte am Portal, einschließlich der Website, Anwendungen und sämtlicher Bestandteile, wie Texte, Dokumente, Fotos, Zeichnungen, Grafiken, Datenbanken, Software, Logos und Marken sowie sonstiger durch Rechte des geistigen oder gewerblichen Eigentums geschützter Zeichen.
Sofern der Nutzer nicht über eine ausdrückliche schriftliche Zustimmung des Portalbetreibers oder der jeweiligen Rechteinhaber verfügt oder nicht gesetzlich dazu befugt ist, ist es untersagt:
- Inhalte des Portals zu vervielfältigen, zu ändern, anzupassen oder zu transformieren,
- Inhalte zu entschlüsseln, zu verbreiten, öffentlich zugänglich zu machen oder zu vermieten,
- Inhalte Dritten zugänglich zu machen.
Der Nutzer darf Inhalte des Portals ausschließlich zu persönlichen, nicht-kommerziellen Zwecken und im Einklang mit diesen Bedingungen verwenden. Jede andere Nutzung, insbesondere zu kommerziellen Zwecken oder zur Verbreitung, ist ohne vorherige schriftliche Zustimmung untersagt.
Von Nutzern über das Portal veröffentlichte Inhalte (z. B. Inserate) müssen den geltenden Vorschriften entsprechen und dürfen keine Rechte Dritter verletzen, einschließlich Urheberrechten und Rechten des geistigen Eigentums. Der Nutzer gewährleistet, dass er über die erforderlichen Rechte am veröffentlichten Material verfügt und dadurch keine Rechte Dritter verletzt.
Schutz personenbezogener Daten
Der Portalbetreiber verarbeitet personenbezogene Daten der Nutzer gemäß den geltenden Datenschutzvorschriften, einschließlich der Datenschutz-Grundverordnung (DSGVO/GDPR).
Detaillierte Informationen zur Verarbeitung personenbezogener Daten, zu den Verarbeitungszwecken, zu den Rechten der Nutzer sowie weitere relevante Informationen sind in der auf dem Portal veröffentlichten Datenschutzerklärung (Privacy Policy) enthalten.
Änderungen der Bedingungen
Der Portalbetreiber behält sich das Recht vor, diese Bedingungen jederzeit zu ändern oder zu ergänzen. Änderungen treten mit ihrer Veröffentlichung auf dem Portal in Kraft und gelten ab diesem Zeitpunkt für alle Nutzer.
Anwendbares Recht und Gerichtsstand
Auf diese Bedingungen findet das Recht der Republik Kroatien Anwendung, soweit zwingende Vorschriften nichts anderes bestimmen.
Für alle Streitigkeiten, die aus der Nutzung des Portals entstehen können, ist das sachlich zuständige Gericht in der Republik Kroatien am Sitz des Portalbetreibers zuständig.
